RULES
PLEASE NOTE: THIS CONTEST IS ONLY OPEN TO LEGAL RESIDENTS
OF THE UNITED STATES EXCEPT IN ANY JURISDICTIONS AND WHEREVER
PROHIBITED BY FEDERAL, STATE, PROVINCIAL, MUNICIPAL OR LOCAL
LAW. NO PURCHASE NECESSARY TO PARTICIPATE OR WIN. A PURCHASE
WILL NOT INCREASE YOUR CHANCE OF WINNING.
ELIGIBILITY:
The RealMagicTV.com contest is open to legal residents of
the fifty (50) United States. You msut be (13) years of age
or older on the date of entry. GIVEAWAY IS SUBJECT TO ALL
FEDERAL, STATE AND LOCAL LAWS AND REGULATIONS. By entering
the giveaway, participants agree to abide by the terms and
conditions of these Official Rules. The following persons
are excluded from participation in this giveaway: employees
of RealMagicTV.com and immediate family members of RealMagicTV.com
employees and its subsidiaries, affiliates, officers, directors,
assigns, advertising, promotional and fulfillment agents,
attorneys, accountants, and other representatives and the
persons with whom each of the above are domiciled.
HOW TO ENTER: Online Entry: To enter, access the official
entry form located at www.RealMagicTV.com/contests.php
or on another section of RealMagicTV.com
Mail Entry: Mail a 3" x 5" card on which you have
hand-written your name, age, mailing address, and email address
in an envelope with a live first-class postage stamp to: Real
Magic TV, Contest Entry, P.O. Box 264, Bedford Hills N.Y.
10507-0264. All entries become the property of RealMagicTV.com
and will not be returned. Limit one entry per person, regardless
of method of entry.
CONTEST PERIOD: All On-line Entries must be received by 11:59:00
P.M. Eastern Standard Time on the date listed under the contest's
details. All Mail Entries must be received by RealMagicTV.com
on or before the same date. SPONSOR RESERVES THE RIGHT TO
TERMINATE OR SUSPEND THE giveaway WITHOUT NOTICE, AT ANY TIME
AND FOR ANY REASON. SPONSOR ALSO RESERVES THE RIGHT TO ALTER
OR AMEND THESE RULES AT ANY TIME PROVIDED, HOWEVER, THE GRAND
PRIZE WILL BE AWARDED UNDER ALL CIRCUMSTANCES.
CONDITIONS
OF ENTRY: Each entrant in the giveaway must be the rightful
owner of, or have authorized use of, the email account indicated
by the entrant's email address. In the event of a dispute
regarding the identity of the person submitting an on-line
entry, the entry will be deemed to be submitted by the person
in whose name the email account is registered. No mechanically
reproduced entries or facsimiles will be accepted. RealMagicTV.com
is not responsible for technical, hardware or software malfunctions,
technical failures of any kind, lost or unavailable network
connections, or failed, incorrect, inaccurate, incomplete,
garbled or delayed electronic communications whether caused
by the sender or by any of the equipment or programming associated
with or utilized in this giveaway or for any undelivered,
deleted, lost, late, illegible, misdirected, incomplete, mutilated
or postage-due entries. RealMagicTV.com reserves the right
to disqualify any individual who is responsible for or who
tampers with the entry process, and to cancel, terminate,
modify, or suspend the on-line portion of the giveaway in
the event it becomes infected by computer virus or is otherwise
technically impaired. Entries become the property of RealMagicTV.com
and will not be returned.
PRIZES:
All Prizes are listed on Contest Description Page.
Only one prize will be awarded per email address, individual,
family, or household. Any federal, state or local taxes or
duties due are the sole responsibility of the winner. Prizes
must be redeemed within ten (10) days of notification. If
winner does not redeem a prize within ten (10) days of notification,
an alternate winner will be selected. All prizes will be awarded.
Winners will be notified by email or U.S. Mail depending upon
manner of entry. Return of any prize notification as undeliverable
will result in disqualification and selection of an alternate
winner.
ODDS OF WINNING: The odds of winning depend upon the number
of eligible entries received.
WINNER SELECTION: Prize winner(s) will be determined on the
basis of a random drawing. The drawing will be conducted on
or about 1 day after entry period ends. All winner selection
procedures shall be conducted by Sponsor whose decisions are
final with respect to all aspects of the giveaway.
NOTIFICATION: Winner will be notified via email. If an email
address is not provided, winner will be contacted via U.S.
mail and/or telephone and/or by overnight courier. The winner
must respond to said notification with 5 business days of
date of notification, or the prize will be forfeited.
By
entering, entrants agree: (1) to be bound by these official
rules; (2) that the decisions of RealMagicTV.com are in all
matters pertaining to the giveaway; and (3) to release and
hold harmless RealMagicTV.com, its subsidiaries, representatives,
sponsor, affiliates, directors, officers, employees and consultants
from any and all liability, injuries, loss or damage of any
kind arising from their participation or their acceptance
and use of any prize.
RELEASE: Potential winners may be required to sign and return
to RealMagicTV.com an affidavit of eligibility and release
of liability (the "Affidavit"), and, if the Affidavit
is not returned within fifteen (15) days of notification,
the potential winner will be deemed to have forfeited the
prize, and an alternate potential winner will be chosen. By
registering for the giveaway or accepting a prize, participants
release RealMagicTV.com, its subsidiaries, representatives,
sponsor, affiliates, directors, officers, employees, advisors,
attorneys and consultants from any and all liability claims
or actions of any kind whatsoever and for injuries, damages
or losses to persons and property which may be sustained in
connection with the receipt, ownership or use of the prizes,
or while preparing for, participating in, and/or traveling
to any prize-related activity. By registering for the giveaway,
participants agrees to the use of their name, address (city
and state only) and/or photograph, videotape or any likeness
for advertising or publicity purposes, and to the use of statements
made by or attributed to participant relating to RealMagicTV.com
, and any and all rights to said use, without further compensation.
LIMITATIONS OF LIABILITY: RealMagicTV.com is not responsible
for any incorrect or inaccurate information, whether caused
by website users or by any of the equipment or programming
associated with the giveaway or by any technical or human
error that may occur in the processing of entries in the giveaway.
RealMagicTV.com assumes no responsibility for any error, omission,
interruption, deletion, defect, delay in operation or transmission,
communications line failure, theft or destruction or authorized
access to, or alteration of, entries. RealMagicTV.com is not
responsible for any problems or technical malfunction of any
telephone network or lines, computer on-line-systems, servers
or providers, computer equipment, software, failure of email
on account of technical problems or traffic congestion on
the Internet or at any website or combination thereof, including
injury or damage to participants or to any other person's
computer related to or resulting from participating or downloading
materials in this giveaway. If, for any reason, the giveaway
is not capable of running as planned, including infection
by computer virus, bugs, tampering, unauthorized intervention,
fraud, technical failures, hacking, or any other causes beyond
the control of RealMagicTV.com which corrupt the administration,
security, fairness, integrity or proper conduct of the RealMagicTV.com
giveaway, RealMagicTV.com reserves the right at its sole discretion
to cancel, terminate, modify or suspend the giveaway. RealMagicTV.com
is not responsible for late, lost, illegible, incomplete,
stolen, misdirected or postage due entries.
ANY
ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY
DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF
THE REALMAGICTV.COM giveaway IS A VIOLATION OF CRIMINAL AND
CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVE
THE RIGHT TO SEEK DAMAGES FROM ANY SUCH ENTRANT TO THE FULLEST
EXTENT PERMITTED BY LAW(INCLUDING ALL ATTORNEYS FEES, COURT
COSTS AND EXPENSES).
